The Complaints Mechanism was established by the Regulation 1624/2016 on the European Border and Coast Guard. It allows anybody directly affected by the actions of staff involved in a joint operation, pilot project, rapid border intervention, migration management support team deployment, migration management support teams, return operation, or return intervention to submit a complaint if the person considers him or herself to have been the subject of a breach of his or her fundamental rights due to those actions, or any party representing such a person.
The Fundamental Rights Officer reviews the admissibility of a complaint and registers admissible complaints. FRO then forwards all registered complaints to the Executive Director and forwards complaints concerning members of the teams to the person’s home Member State. In addition, the FRO informs the relevant authority or body competent for fundamental rights in a Member State and ensures a follow-up by the Agency or that Member State.
